1. Agreement to these terms
These Terms of Service govern your use of the Kirby's Cards online store and any purchase you make through it. By accessing the store or placing an order, you agree to these terms and the policies referenced here, including our Refund Policy and Privacy Policy.
The store is operated by Kirby's Cards LLC in Burke, Virginia. Questions may be sent to [email protected].
2. Eligibility and accounts
You must be at least the age of majority where you live, or have permission from a parent or legal guardian, to use the store or make a purchase. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
3. Products, condition, pricing, and availability
We make reasonable efforts to describe products, card printings, condition grades, images, and availability accurately. Scanner glare, dust, or white lines in an image may not represent damage to the physical card. Buyers should review all available listing images and details before purchasing.
Inventory is limited and may sell out. We may correct errors, update information, limit quantities, or cancel an order if a product, price, or availability was listed incorrectly.
All prices are shown in U.S. dollars unless checkout clearly displays another currency. Taxes and shipping charges are added at checkout when applicable.
4. Orders and payment
Submitting an order is an offer to purchase. We may accept or decline an order for a lawful reason, including suspected fraud, inventory error, or inability to fulfill the order.
Payments are processed by Stripe through the SortSwift-hosted storefront. By submitting payment, you authorize the charge shown at checkout, including applicable taxes and shipping. We do not store full payment-card numbers.
You agree to provide current and accurate contact, billing, shipping, and payment information.
5. Shipping and delivery
Available shipping methods, prices, and estimated delivery times are shown at checkout. Delivery dates are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or events outside our reasonable control.
Buyers are responsible for providing a complete and accurate delivery address. Risk of loss passes to the buyer when the order is delivered to the carrier, except where applicable law provides otherwise.
6. Returns, cancellations, and refunds
Returns, cancellations, exchanges, and refunds are governed by our Refund Policy. That policy is incorporated into these Terms by reference.
7. Acceptable use
You may use the store only for lawful personal or household purposes. You may not interfere with the store, attempt unauthorized access, introduce harmful software, scrape or copy protected content without permission, impersonate another person, commit fraud, or use the store in a way that violates applicable law or the rights of others.
8. Intellectual property
The Kirby's Cards name, logo, site design, text, and original content are owned by Kirby's Cards LLC or used with permission. Card names, images, game logos, and third-party trademarks remain the property of their respective owners. No rights are granted except the limited right to use the store for its intended purpose.
9. Third-party services and links
The store uses third-party services, including SortSwift for storefront and inventory functions, Stripe for payments and tax calculations, shipping carriers, and other providers needed to operate the business. Their services may be governed by their own terms and privacy notices.
Links to third-party websites are provided for convenience. We do not control and are not responsible for their content, security, or practices.
10. Reviews and other submissions
If you submit a review, question, message, image, or other content, you confirm that you have the right to submit it and that it is accurate and lawful. You grant Kirby's Cards a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with operating and promoting the store. We may remove submissions that violate these Terms.
11. Disclaimers and limitation of liability
To the fullest extent permitted by law, the store and its content are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by applicable law, Kirby's Cards LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of the store or a purchase. Our total liability for a claim relating to an order will not exceed the amount paid for that order. These limitations do not exclude rights or remedies that cannot lawfully be excluded.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia and applicable United States law, without regard to conflict-of-law principles. Mandatory consumer-protection rights in your place of residence remain unaffected.

We may update these Terms from time to time. The date above identifies the latest revision. Continued use of the store after an update means the revised Terms apply to future use and purchases.
